U.S. District Judge Tucker Melancon refused Thursday to close Ville Platte High School before school begins next month, allowing the Evangeline Parish School Board a week to decide if it will declare an emergency and call another tax election for November. Ville Platte voters on July 19 again rejected a tax to finance construction of a new school, the second time they’ve said no in the last 10 months.

The Justice Department objected to Melancon’s decision, saying further desegregation action should be taken for the start of the upcoming school year.

Melancon took the position that allowing the School Board one more chance to secure a dedicated tax would only delay the process six months.

Considering the litigation involved has been active for more than 40 years, he felt that is not an undue delay.

But he did order the board to began making formal plans for reassigning students attending the school or or zoned to do so in the 2009-10 school year.
