The meeting was called to order by Vice-Chairman Lloyd Higginbotham.
The Invocation was read by Laci Laperouse and the Pledge of Allegiance was led by Carroll Delahoussaye. Vice-Chairman Lloyd Higginbotham turned the meeting over to Council member Mike Huval. At this time Council member Carroll Delahoussaye acknowledged and congratulated, on behalf of the St. Martin Parish Council, Jonah Dru Cormier for his accomplishments in his many winnings in motocross racing. Jonah is the son of Guy and Darlene Cormier. Council member Carroll Delahoussaye presented Jonah with a resolution for his outstanding achievements. Jonah thanked the Council members for this recognition and also thanked his family, friends, and sponsors for supporting him.
Council member Mike Huval recognized Mr. Raymond Reaux, P.E., Vice-President Engineering Division of C.H. Fenstermaker & Associates, Inc. and Mayor Wilson B. Viator, Jr. of the City of Youngsville who were present to discuss the configuration of the roadway intersection of Louisiana State Highway 90 and Aillet Road within St. Martin Parish. After a lengthy discussion of the plans, Council member Lisa Nelson questioned Mayor Wilson B. Viator, Jr. of the City of Youngsville if this plan involved annexing St. Martin Parish. Per Mayor Viator, there are no plans on annexing in St. Martin Parish only in Lafayette Parish. Parish President Guy Cormier thanked Mayor Viator and explained that St. Martin Parish Government has requested DOTD to make this a safer intersection. Parish President Guy Cormier also stated that it is in our best interest to support this configuration for safety from a public stand point. Council member Mike Huval thanked Mayor Viator and Mr. Raymond Reaux for being present at the meeting. At this time Council member Mike Huval skipped ahead to this evening’s extension item for Resolution Summary No. 128-RS which is the resolution in support of the City of Youngsville’s pursuit of replacing the configuration of the roadway intersection of Louisiana State Highway 90 and Aillet Road within St. Martin Parish.

RESOLUTION NO. 10-128-RS
WHEREAS, the Mayor and City Council of Youngsville, governing authority of the City of Youngsville wishes to cooperate with St. Martin Parish in pursuit of replacing the configuration of the roadway intersection of Louisiana State Highway 90 and Aillet Road within St. Martin Parish. In that pursuit, be it known that this intersection reconfiguration is a DOTD required part of the City of Youngsville Project to install a roadway between Louisiana State Highway 89 and the western most end of Aillet Road; and
WHEREAS, the City of Youngsville will have sole responsibility for all engineering and construction of the proposed intersection design; and
WHEREAS, the DOTD shall be the final approval authority over the design and installation of the proposed intersection and has given preliminary approval of the proposed three phase intersection design; and
WHEREAS, the City of Youngsville has obtained full funding for both the proposed roadway between Louisiana State Highway 89 and Aillet Road as well as the three phase intersection reconfiguration design and installation; and
WHEREAS, the property owners which abut Aillet Road and Louisiana State Highway 90 at the proposed intersection have been contacted and are in agreement with the proposed three phase intersection configuration; and
WHEREAS, St. Martin Parish shall not have any financial or fiscal obligations relative to the completion of this project including the reconfiguration of the Louisiana State Highway 90 and Aillet Road;and
WHEREAS, the City of Youngsville, acting through its Mayor and City Council, has assured the Parish President and Parish Council of St. Martin Parish that the proposed highway project embraced herein is not a precursor for an attempt to annex the area of St. Martin Parish in which the road project is situated.
NOW, THEREFORE, BE IT RESOLVED that the St. Martin Parish Council does hereby support the City of Youngsville in their pursuit of replacing the configuration of the roadway intersection of Louisiana State Highway 90 and Aillet Road within St. Martin Parish.

ANNUAL CERTIFICATION OF COMPLIANCE
WITH STATE OF LOUISIANA
OFF SYSTEM BRIDGE REPLACEMENT PROGRAM
WHEREAS, the Code of Federal Regulations as enacted by the United States Congress mandates that all structures defined as bridges located on all public roads shall be inspected, rated for safe load capacity and posted in accordance with the National Bridge Inspection Standards and that an inventory of these bridges be maintained by each State; and
WHEREAS, the responsibility to inspect, rate and load post those bridges under the authority of St. Martin Parish in accordance with those Standards is delegated by the Louisiana Department of Transportation and Development to St. Martin Parish.
NOW, THEREFORE, BE IT RESOLVED by the St. Martin Parish Council, in Regular Session convened this 2nd day of November, 2010, that the St. Martin Parish Government (herein referred to as the Parish) does hereby certify to the Louisiana Department of Transportation and Development (herein referred to as the DOTD) that for the period October 1, 2009 through September 30, 2010:
1. The Parish has performed all interim inspections on all Parish owned or maintained bridges in accordance with the National Bridge Inspection Standards.
2. All bridges owned or maintained by the Parish have been structurally analyzed and rated by the Parish as to the safe load capacity in accordance with AASHTO Manual for Maintenance Inspection of Bridges. The load posting information that has been determined by the LA DOTD for all bridges where the maximum legal load under Louisiana State law exceeds the load permitted under the operating rating as determined above has been critically reviewed by the Parish. Load posting information has been updated by the Parish to reflect all structural changes, any obsolete structural ratings or any missing structural ratings.
3. All Parish owned or maintained bridges which require load posting or closing are load posted or closed in accordance with the table in the DOTD Engineering Directives and Standards Manual Directive No. 1.1.1.8. All DOTD supplied load posting information concerning a bridge has been critically reviewed by the Parish Engineer prior to load posting.
4. All bridges owned or maintained by the Parish are shown on the attached list in the format specified by the DOTD. Corrections to data supplied to the Parish by the LA DOTD are noted.
These stipulations are prerequisites to participation by the Parish in the Off System Bridge Replacement Program.

Independent Audit, “the Council shall provide for an annual independent post fiscal year audit, and such additional audits as it deems necessary, of the accounts and other evidence of financial transactions of the Parish government, including those of all parish government departments, offices or agencies”; and
WHEREAS, the Parish of St. Martin has engaged the services of Maraist & Maraist Certified Public Accountants for the past several years to conduct their annual audit; and
WHEREAS, the Parish is satisfied with the quality of services rendered and the reasonableness of the fees charged for said audit.
NOW, THEREFORE, BE IT RESOLVED that the St. Martin Parish Council, in Regular Session convened this 2nd day of November, 2010, does hereby approve engaging the services of Maraist & Maraist Certified Public Accountants to conduct the annual audit for the year 2010 for St. Martin Parish.

WHEREAS, Louisiana’s memorialized deceased veterans number over 7,000, and living veterans, who have also worn its nation’s uniform in defense of freedom number in excess of 446,000; and
WHEREAS, we can never repay our debt to our veterans for the privilege of liberty, for it is beyond any tangible price, but we can show our gratitude and appreciation for their exemplary deeds; and
WHEREAS, our Armed Forces have earned a special day, in which Louisiana’s citizens -- and more particularly the citizens of St. Martin Parish -- may focus on their heroic accomplishments, and pay tribute with our hearts and minds to our living veterans and their deceased comrades, remembering to visit them in their places of rest, our hospitals and their homes; and
WHEREAS, in order that we pay meaningful tribute to those men and women who proudly served in our Armed Forces, Congress has provided that November 11th shall be set aside each year as a legal public holiday to honor America’s veterans.

WHEREAS, Architect Professional Engineering Consultants Corporation has recommended Change Order No. 1 in the amount of $746.00 (increase).

A resolution to authorize an intergovernmental agreement for medical services at the St. Martin Parish Correctional Center:
WHEREAS, the ST. MARTIN PARISH GOVERNMENT recognizes its legal obligation to provide medical services for and/or on behalf of pretrial detainees and parish prisoners incarcerated in the St. Martin Parish Correctional Center;
WHEREAS, SHERIFF RONALD THERIOT is the “keeper” of all jail facilities situated in St. Martin Parish, Louisiana, in accordance with the dictates of La.R.S. 15:704;
WHEREAS, St. Martin Parish, Louisiana, is the benefactor of a law enforcement district created pursuant to the provisions of La.R.S. 33:9001, et seq;
WHEREAS, in accordance with La.R.S. 33:9001, RONALD THERIOT, as the duly elected SHERIFF OF ST. MARTIN PARISH, LOUISIANA, is the Chief Executive Officer of the ST. MARTIN PARISH LAW ENFORCEMENT DISTRICT;
WHEREAS, the constitution and statutes of the State of Louisiana deem the duly elected SHERIFF OF ST. MARTIN PARISH, LOUISIANA, to be the Chief Law Enforcement Officer for the parish;
WHEREAS, the medical costs associated with healthcare services rendered on behalf of pretrial detainees and parish prisoners have significantly increased over the last several years;
WHEREAS, SHERIFF RONALD THERIOT has advised the ST. MARTIN PARISH GOVERNMENT that he shall no longer employ jail nurses or medics to service the St. Martin Parish Correctional Center;
WHEREAS, SHERIFF RONALD THERIOT and the ST. MARTIN PARISH GOVERNMENT both desire that all steps be adopted to insure that all legal mandates are satisfied relative to the rendition of medical services for and on behalf of pretrial detainees and parish prisoners;
WHEREAS, the ST. MARTIN PARISH GOVERNMENT and the duly elected SHERIFF OF ST. MARTIN PARISH, LOUISIANA (acting in his official capacity as Sheriff and as the Chief Executive Officer for the ST. MARTIN PARISH LAW ENFORCEMENT DISTRICT), have always jointly engaged in cooperative endeavors to protect and insure the safety of the inmates housed in the St. Martin Parish Correctional Center;
WHEREAS, the ST. MARTIN PARISH GOVERNMENT and the Office of SHERIFF OF ST. MARTIN PARISH, LOUISIANA, jointly acknowledge that St. Martin Parish is a rural community with limited resources, and there are no dedicated revenue sources which can be used to provide healthcare services for and on behalf of parish inmates and pretrial detainees;
WHEREAS, the cooperative and mutual endeavors between the ST. MARTIN PARISH GOVERNMENT and the duly elected SHERIFF OF ST. MARTIN PARISH, LOUISIANA, provide an excellent vehicle by which to combine resources and services to protect and insure the safety of the parish inmates and pretrial detainees housed in the St. Martin Parish Correctional Center:
NOW, BE IT THEREFORE RESOLVED, that the ST. MARTIN PARISH COUNCIL hereby authorizes, empowers, and directs that the Parish President, GUY CORMIER, acting on behalf of the ST. MARTIN PARISH GOVERNMENT, enter into an intergovernmental agreement with SHERIFF RONALD THERIOT in his capacity as SHERIFF OF ST. MARTIN PARISH, LOUISIANA, and/or the Chief Executive Officer of the ST. MARTIN PARISH LAW ENFORCEMENT DISTRICT for the express purpose of defining the parameters by which medical services are to be rendered to parish prisoners and pretrial detainees housed at the St. Martin Parish Correctional Center.
BE IT FURTHER RESOLVED that the Parish President be and is hereby authorized, empowered, and directed to negotiate the aforesaid intergovernmental agreement on such terms and conditions as he deems necessary and fit in his discretion to confect a cooperative agreement which would permit the rendition of medical services on behalf of parish prisoners and pretrial detainees in an effective and economic manner.
BE IT FURTHER RESOLVED that the Parish President, GUY CORMIER, shall have the authority and/or approval of the ST. WHEREAS, the St. Martin Parish Council regretfully accepted the resignation of Mr. Kenneth Soignier as a member of the St. Martin Parish 911 Emergency Board of Commissions; and
WHEREAS, Mr. Calder Hebert has been recommended to fill the vacancy of the St. Martin Parish 911 Emergency Board of Commissions created by Mr. Soignier’s resignation.
NOW, THEREFORE, BE IT RESOLVED that the St. Martin Parish Council does hereby appoint Mr. Calder Hebert to fill the unexpired term of Mr. Kenneth Soignier as a board member on the St. Martin Parish 911 Emergency Board of Commissions; said appointment will expire on March 1, 2012.

Council member Mike Huval acknowledged Mr. Trevor Haynes with Foley and Judell, L.L.P. who was present at the meeting to answer any questions that the council may have regarding Resolution Summary No. 127-RS. Mr. Haynes stated that this Library Tax Renewal will bring an estimated $884,000 per year for the library system. Also present was Ms. Charlar Brew, St. Martin Parish Librarian. Parish President Guy Cormier and Council member Mike Huval complimented and thanked Ms. Brew for spreading the word to the public concerning this Library Tax Renewal.

RESOLUTION NO. 10-127-RS
A resolution providing for canvassing the returns and declaring the result of the special election held in the Parish of St. Martin, State of Louisiana, on Saturday, October 2, 2010, to authorize the renewal of a special tax therein.
BE IT RESOLVED by the St. Martin Parish Council (the “Governing Authority”), acting as the governing authority of the Parish of St. Martin, State of Louisiana, that:
SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the Parish of St. Martin, State of Louisiana, on SATURDAY, OCTOBER 2, 2010, to authorize the renewal of a special tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.
SECTION 2. Procès Verbal. A Procès Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of St. Martin, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.
SECTION 3. Promulgation of Election Result. The result of said election shall be promulgated by publication in the manner provided by law.

Council member Lisa Nelson thanked Parish President Guy Cormier for taking time to inform the public about Amendment No. 2. Parish President Guy Cormier stated that he has given an estimated 52 presentations across Louisiana concerning same. Council member Mike Huval reminded everyone to vote if they have not done so already.
A motion was made by Carroll Delahoussaye seconded by Jason Willis that the St. Martin Parish Council does hereby adjourn. Motion was unanimously approved.
