Mayor Thomas Nelson presiding, called the meeting to order.
Upon motion of Arthur Champ duly seconded by Ronald Charles and unanimously carried that the minutes of the regular meeting held October 18, 2010 hereby be approved as written and prepared for publication in the Teche News, the Official Journal of the City of St. Martinville.
Upon motion of Ronald Charles duly seconded by Craig Prosper and unanimously carried that the bills to be paid by the City Finance Committee hereby be approved for payment.
Member of the Knights of Peter Claver presented a PA System to the Parks and Recreation Department as a token of appreciation for the use of the Adam Carlson Park for various events sponsored by the organization.
Upon written request of St. Lucy Committee, it was moved by Craig Prosper duly seconded by Mike Fuselier and unanimously carried that permission be hereby granted to close Evangeline Blvd. from St. Martin Street to Main Street on Sunday, December 12, 2010 from 8:00 am until 7:00 pm. to hold the annual St. Lucy Festival of Lights.
Upon motion of Craig Prosper duly seconded by Mike Fuselier and unanimously carried that the pay request #5 for the Sewerage Treatment Facility Upgrade Project submitted by Comeaux Engineering & Consultants on behalf of M.P. Dumensnil Const., Co., LLC in the amount of $487,272.10 be hereby approved.
AMENDMENT OF FLOOD DAMAGE PREVENTION ORDINANCE
An Ordinance by the City Council of the City of St. Martinville
WHEREAS the City of St. Martinville currently has a Flood Prevention Damage Ordinance in effect, and
WHEREAS the Federal Emergency Management Agency has required that certain amendments be made thereto,
THEREFORE be it ordained that the FLOOD DAMAGE PREVENTION ORDINANCE for the City of St.Martinville is amended by renumbering “Section E - Severability” as “Section H - Severability”, and by replacing it with “Section E - Floodways” in the form attached as Exhibit “A” hereto, and said amendments are hereby adopted retroactive to November 1, 2010.
The foregoing Ordinance was offered by Craig Prosper, duly seconded by Arthur Champ, and upon being submitted to a vote, the vote was :

Absent: Councilman D.Williams
The Ordinance was thereon declared adopted on the 8th day of November, 2010.

“SECTION E. FLOODWAYS
Floodways - located within areas of special flood hazard established in Article 3, Section B, are areas designated as floodways. Since the floodway is an extremely hazardous area due to the velocity of flood waters which carry debris, potential projectiles and erosion potential, the following provisions shall apply:
(1) Encroachments are prohibited, including fill, new construction, substantial improvements and other development within the adopted regulatory floodway unless it has been demonstrated through hydrologic and hydraulic analyses performed in accordance with standard engineering practice that the proposed encroachment would not result in any increase in flood levels within the community during the occurrence of the base flood discharge.
(2) If Article 5, Section E(1) above is satisfied, all new construction and substantial improvements shall comply with all applicable flood hazard reduction provisions of this Ordinance..
(3) Under the provisions of 44 CFR Chapter 1, Section 65.12, of the National Flood Insurance Program Regulations, a community may permit encroachments within the adopted regulatory floodway that would result in an increase in base flood elevations, provided that the community first completes all of the provisions required by Section 65.12.”
Upon request of Chief Smith, it was moved by Arthur Champ duly seconded by Ronald Charles and unanimously carried that Mitch Reed be hired as a Reserve Officer, with a rate of pay of $8.00 hour.
It was moved by Arthur Champ duly seconded by Ronald Charles that the City Council go into executive session to discuss personnel matters.
The City Council, excluding Craig Prosper, reconvened after executive session upon motion of Mike Fuselier duly seconded by Ronald Charles.
Upon motion of Mike Fuselier duly seconded by Ronald Charles and unanimously carried that Rapheal Hebert, Public Works Dispatcher, be hereby placed on administrative leave without pay for 5 days, at the Public Works Superintendent’s discretion.
The Council requested that Chief Smith provide information regarding various matters concerning the Police Department that were discussed in executive session.
Upon motion of Mike Fuselier duly seconded by Arthur Champ and unanimously carried that City Attorney Allan Durand prepare a policy for notification of arrest of any City employees.
There being no further business to come before the Mayor and City Council, Mayor Thomas Nelson adjourned the meeting upon motion of Ronald Charles duly seconded by Arthur Champ.
